Multi-Tenant Architecture

NiceHatCRM provides a multi-tenant architecture that allows you to manage multiple clients or business units. You are responsible for:

• Properly configuring and using the multi-tenant features.
• Maintaining appropriate data separation between tenants.
• Ensuring proper access controls for each tenant.
• Complying with all applicable laws regarding data storage and privacy for each tenant.

Payment Terms

Subscription Plans

Some of our Services are available on a subscription basis. By selecting a subscription plan, you agree to pay the subscription fees as described at the time of purchase.

Billing Cycle

We will bill you in advance on a recurring and periodic basis (monthly or annually, depending on your subscription plan). Billing cycles are set on a calendar basis.

Free Trial

We may offer a free trial period for our subscription Services. At the end of the trial period, we will automatically begin charging you the applicable subscription fee unless you cancel your subscription before the end of the trial period.

Refunds

Except as required by law, all payments are non-refundable. However, we may provide refunds or credits at our sole discretion.

Fee Changes

We may change our fees at any time. If we change our fees, we will provide notice of the change on the Site or by email, at our discretion. Your continued use of the Services after the fee change becomes effective constitutes your agreement to pay the changed amount.

User Content

You retain any and all of your rights to any Content you submit, post, or display on or through the Services and you are responsible for protecting those rights.

• Infringes on any patent, trademark, trade secret, copyright, or other intellectual property right.

• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
• Impersonates any person or entity or falsely states or otherwise misrepresents your affiliation with a person or entity.

Service Content

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of NiceHatCRM and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of NiceHatCRM.

Feedback

If you provide us with any feedback or suggestions regarding the Services ("Feedback"), you hereby assign to us all rights in such Feedback and agree that we shall have the right to use and fully exploit such Feedback in any manner we deem appropriate.

Termination

Termination by You

You may terminate your account at any time by contacting us or by following the instructions provided in the Services. Upon termination, your right to use the Services will immediately cease.

Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Effects of Termination

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
